This Privacy Policy applies specifically to the SMS notification program (the “SMS Program”) operated by Corrections Software Solutions, LP (“CSS,” “we,” “us,” or “our”) on behalf of probation, pretrial supervision, and similar community supervision agencies (each, an “Agency”). It describes how we collect, use, and disclose information in connection with text message notifications sent to individuals enrolled in supervision (each, a “Recipient” or “you”).
This Privacy Policy does NOT cover the CSS Mobile application or other CSS software products. For information about those products, see the separate CSS Mobile Privacy Policy at https://correctionssoftware.com/privacy-policy/.
About the SMS Program
CSS provides a text messaging service that allows Agencies to send the following types of notifications to individuals under their supervision:
- Appointment and court date reminders
- Payment and fee reminders
- Emergency closures and county notifications
Agencies using the SMS Program operate in multiple U.S. states, including Texas, California, Florida, and Utah. CSS is the technical operator of the messaging platform; the Agency is the originator of the messages and the entity with the supervisory relationship to the Recipient.
Information We Collect
In connection with the SMS Program, we collect:
- Your mobile telephone number
- Records of your enrollment status in the SMS Program, and a history of any changes to your opt-in or opt-out status
- Records of messages sent to and received from your mobile number through the SMS Program
- Inbound keyword replies (such as STOP, START, and HELP)
We do not collect the content of your other text communications, your contacts, your location, or any information beyond what is described above.
How Your Phone Number Is Collected
Your phone number is provided to CSS by your supervising Agency. The Agency obtains your number from supervision intake records and other case-management information collected as part of your supervision relationship with the Agency.
Consent and Enrollment
You are enrolled in the SMS Program by your supervising officer at the Agency, typically at supervision intake. As part of intake, your officer will explain that you will receive text message reminders for appointments, payments, and other supervision-related notifications. You may decline to participate. Your supervising officer enrolls you in the CSS system, which maintains a record of your enrollment status and any subsequent changes.
How We Use Your Information
We use your phone number and related information to:
- Deliver SMS messages scheduled by your supervising Agency
- Maintain records of message delivery, opt-in, and opt-out
- Respond to keyword replies (HELP, STOP)
- Provide message delivery reports and records to your supervising Agency
- Comply with legal obligations and respond to lawful requests
We do not use your information for marketing or promotional purposes.
Information Sharing — No Sale, No Marketing
Mobile information (phone numbers and SMS opt-in/consent data) collected through the SMS Program will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are not shared with any third parties.
The only parties with access to phone numbers and message data collected through the SMS Program are:
- Your supervising Agency, which originated the messages
- CSS, as the platform operator
- Downstream messaging service providers and wireless carriers (such as Plivo, Inc. and U.S. mobile carriers) strictly necessary to transmit messages between CSS and your wireless device
We may also disclose information when required by law, in response to a valid subpoena or court order, to protect the rights or safety of CSS or others, or as authorized by your supervising Agency in connection with your supervision.
Message Frequency
Typical message frequency is approximately 2–3 messages per month, but actual frequency depends on your supervision schedule, payment status, and Agency activity.
Message and Data Rates
Standard message and data rates from your wireless carrier may apply to messages sent to and received from the SMS Program. Neither CSS nor the Agency charges you for SMS messages sent through the SMS Program.
HELP Keyword
If you reply HELP to any SMS Program message, you will receive an automated response with information about the SMS Program and how to contact your supervising officer or CSS for support.
STOP and Opt-Out
You may opt out of the SMS Program at any time by replying STOP to any SMS Program message. When you reply STOP, CSS will mark your number as opted out in our system and you will receive one confirmation message. No further SMS Program messages will be sent to your number after that.
To re-enroll after opting out, you must contact your supervising officer at your Agency.
The SMS Program does not support automatic re-enrollment by texting START or any other keyword to the original Program number. When your supervising officer initiates re-enrollment in the CSS system, you will receive a one-time opt-in invitation from a separate number. To complete re-enrollment, you must respond to that invitation to confirm consent. Until you respond, no further SMS Program messages will be sent.
Data Retention
CSS retains your phone number and SMS Program records for the duration of your enrollment with your supervising Agency and, after your supervision ends, as required by the Agency’s case management retention policies and applicable law. If you opt out of the SMS Program, CSS retains your phone number indefinitely on an opt-out suppression list to ensure that no further SMS messages are sent to your number unless and until you re-enroll through your supervising officer.
Data Security
We use commercially reasonable physical, electronic, and procedural safeguards to protect SMS Program data. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
Your State Privacy Rights
Depending on the state in which you reside, you may have additional rights regarding your personal information, including the right to access, correct, delete, or receive a copy of the information we hold about you, and the right to opt out of certain uses or disclosures. To exercise these rights, contact your supervising officer at your Agency, who will coordinate with CSS to respond to your request.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated policy will be posted at this URL with a revised Effective Date. Continued enrollment in the SMS Program after a change becomes effective constitutes acceptance of the revised policy.
