These SMS Program Terms and Conditions (“Terms”) govern your participation in the text message notification program (the “SMS Program”) operated by Corrections Software Solutions, LP (“CSS,” “we,” “us,” or “our”) on behalf of probation, pretrial supervision, and similar community supervision agencies (each, an “Agency”). By providing consent to your supervising officer at intake (or otherwise participating in the SMS Program), you agree to these Terms and to the SMS Program Privacy Policy.
These Terms do not govern the CSS Mobile application or other CSS software products. For terms applicable to those products, see the separate Terms and Conditions at https://correctionssoftware.com/terms-and-conditions-css-mobile/.
1. Description of the SMS Program
The SMS Program enables Agencies to send the following types of text message notifications to individuals enrolled in supervision (each, a “Recipient”):
- Appointment and court date reminders
- Payment and fee reminders
- Emergency closures and county notifications
CSS is the technical operator of the messaging platform; the Agency is the originator of the messages.
2. Eligibility
Participation in the SMS Program is limited to individuals 18 years of age or older who are under the supervision of a participating Agency and who have provided consent to receive SMS messages from the Agency through CSS.
3. Consent and Enrollment
You are enrolled in the SMS Program by your supervising officer at the Agency, typically at supervision intake. As part of intake, your officer will explain that you will receive text message reminders. By consenting to enrollment when offered, you agree to these Terms and to the SMS Program Privacy Policy. You may decline enrollment. Your enrollment is recorded by your officer in the CSS system.
4. Message Frequency
Typical message frequency is approximately 2–3 messages per month. Actual frequency varies based on your supervision schedule, payment status, and Agency activity.
5. Message and Data Rates
Standard message and data rates from your wireless carrier may apply. Neither CSS nor the Agency charges you for SMS messages sent through the SMS Program.
6. HELP
Reply HELP to any SMS Program message to receive information about the SMS Program and how to contact your supervising officer or CSS for support.
7. STOP and Opt-Out
You may opt out at any time by replying STOP to any SMS Program message. You will receive one confirmation message, after which no further SMS Program messages will be sent to your number.
8. Re-Enrollment After Opt-Out
The SMS Program does not support automatic re-enrollment by replying to a message. If you opt out and later want to receive SMS notifications again, you must contact your supervising officer at your Agency. When your supervising officer initiates re-enrollment in the CSS system, you will receive a one-time opt-in invitation from a separate number. To complete re-enrollment, you must respond to that invitation to confirm consent.
9. No Guarantee of Delivery
CSS uses commercially reasonable efforts to deliver SMS messages reliably and on time. However, message delivery depends on factors outside our control, including wireless carrier networks, carrier filtering, network congestion, device availability, signal strength, and software or hardware issues with your device.
CSS does not guarantee that any particular SMS message will be delivered, will be delivered on time, or will be received by you. You should not rely solely on the SMS Program for time-sensitive information such as appointment times, court dates, or payment deadlines. It is your responsibility to confirm appointments, court dates, payment deadlines, and other information directly with your supervising officer.
10. User Responsibilities
You are responsible for:
- Providing your supervising officer with an accurate mobile phone number
- Notifying your supervising officer promptly of any change to your mobile phone number
- Maintaining an active wireless service account capable of receiving SMS messages
- Promptly replying STOP if you no longer wish to receive messages or if the mobile number is no longer your number
If your phone number changes and you do not notify your Agency, messages intended for you may be sent to the new owner of the number. CSS and the Agency are not responsible for any unintended disclosure that results from your failure to update your phone number with the Agency.
11. Changes to the SMS Program
CSS and the Agency may modify, suspend, or discontinue any aspect of the SMS Program at any time without notice. Neither CSS nor the Agency is liable for any such modification, suspension, or discontinuance. These Terms are governed by the laws of the State of Texas, USA.
12. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised Effective Date. Continued participation in the SMS Program after a change becomes effective constitutes acceptance of the revised Terms.
13. Contact
For questions about these Terms, the content of specific messages, your appointments, your payments, or your supervision generally, contact your supervising officer at your Agency. Your supervising officer will coordinate with CSS as needed to respond to your request.
